Scale Up Worker Visa: Application & Guidance UK

The Scale Up Worker Visa allows skilled foreign professionals to work in the UK. Initially, this visa requires a job offer and sponsorship from a recognised UK business. After six months, however, individuals can work without a sponsor, offering greater flexibility.

Everything You Need to Know About UK Scale-up Worker Visa

UK Scale-up Worker Visa Overview

Introduced on August 22, 2022, the Scale Up Worker Visa is designed for skilled foreign professionals aiming to contribute to fast-growing UK businesses. This visa category facilitates UK companies’ employment of exceptional global talent in significant expansion phases—commonly known as ‘scale-up businesses’.

To qualify for this visa, a professional must secure a job offer and a Certificate of Sponsorship from an authorised scale-up business.

The initial visa grant permits a stay of two years, which can be extended for another three years, allowing a total stay of up to five years. Notably, after the first six months of employment under the sponsored role, visa holders can swap to an unsponsored role within the UK, enhancing their job mobility.

After completing five continuous years in the UK under the scale-up visa, individuals may become qualified to apply for Indefinite Leave to Remain (ILR), a route to permanent residence.

Understanding Scale-up Companies

Scale-up companies are businesses recognised for their rapid growth. To qualify as a scale-up, a company must have demonstrated a significant expansion in the three years preceding its application for a sponsor licence from the Home Office.

Specifically, these businesses must have achieved at least a 20% annual growth in employment numbers or total sales (turnover). Additionally, they must have started the three years with a minimum of 10 employees.

Currently, there are approx. 34,000 businesses in the UK fulfil these standards and are classified as scale-up companies.

To sponsor foreign professionals under the Scale-Up Worker Visa, these businesses must be listed as A-rated on the official list of authorised UK sponsors. This rating indicates that the Home Office trusts the company to meet all necessary compliance responsibilities associated with sponsorship.

general requirements

Scale Up Worker Visa Eligibility Requirements

To qualify for the Scale Up Worker UK Visa, applicants must fulfil several specific criteria, ensuring they are well-suited for roles within the UK’s rapidly growing scale-up businesses. Here are the requirements a worker must fulfil to be eligible for the scale-up route:

  1. Job Offer: Applicants must have a job offer from a qualifying and approved scale-up business, confirmed to last for at least six months.
  2. Certificate of Sponsorship (CoS): A valid certificate of sponsorship (CoS) from the scale-up sponsor is essential. This document verifies that the applicant has a genuine job offer and that the job fits the visa requirements and adheres to immigration rules.
  3. Eligible Occupation: The position needs to be on the UK’s list of eligible occupations. Each eligible job is allocated a specific 4-digit occupation code, which applicants can use to verify their job’s eligibility.
  4. Salary Requirements: The sponsor must offer £36,300 per year or the ‘going rate’ for the specific job type, whichever is higher. The ‘going rate’ is outlined in the list of eligible occupations and varies depending on the specific job and its responsibilities.
  5. English Language Proficiency: Applicants must meet certain English language requirements, which can be satisfied in one of the following ways:
    • Being a national from an eligible English-speaking country.
    • Holding a degree or higher academic qualification conducted in English.
    • Having a school-level qualification obtained at a UK school started before the age of 18.
    • Passing an approved English language test at CEFR level B1 or higher.

Financial Requirement: Applicants must demonstrate financial self-sufficiency by having at least £1,270 in their bank account for 28 consecutive days before applying. This criterion is exempt for those who have already lived in the UK for a year or more.

Scale-up Visa: Sponsored and Unsponsored Routes

A unique aspect of the Scale Up Worker Visa route is its dual-route system, which offers both sponsored and unsponsored employment phases.

Applicants must first be sponsored by a qualifying scale-up business, meet strict eligibility requirements, and secure a sponsor licence application. This sponsorship is crucial for workers to start their journey in the UK under the framework.

After six months of sponsored employment, Scale Up Worker Visa holders gain considerable flexibility. They can transition to different jobs or employers without needing a new sponsor, expanding their opportunities to stay and potentially settle permanently in the UK.

This phase allows the skilled worker to explore a broader range of employment options, as many UK businesses do not hold sponsor licences. This is a significant advantage for diversifying their career paths in the UK. Visa holders also have the option to become self-employed, further enhancing their ability to contribute to the UK economy.

If visa holders opt to switch their job or employer after six months, they need not apply for a new visa but must continue to meet the minimum salary threshold for their visa extension.

However, should they need to change employers within the first six months, they must update their visa status with the Home Office online, ensuring the new position still aligns with the list of eligible occupations.
